Court Remands Case for Asylum Seeker Who “Failed” to Prove He Was Gay by Haley Larkin | May 13, 2022
Attorney Oscar Ischiu was asked to comment in a recent article describing a case in the Ninth Circuit Court of Appeals hearing the appeal of a Nigerian citizen whose request for asylum in the United States was denied by the Immigration Judge and the Board of Immigration Appeals. The immigration judges didn’t believe the plaintiff had proven his case that he would be in danger in his home country due to his sexual orientation being exposed, but the Ninth Circuit sent the case back for further review.
